1. Seller Registration and Account

• Registration: To become a seller on PPE CART, you must complete the registration process, provide accurate information, and agree to these Terms.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activities that occur under your account.
• Eligibility: By registering as a seller, you confirm that you have the legal capacity to enter into a contract and that your business complies with all applicable laws and regulations.

2. Listing Products

• Product Compliance: All products listed on PPE CART must comply with relevant Australian laws and regulations, including safety standards and consumer protection laws.
• Accurate Descriptions: You must provide accurate and complete descriptions of your products, including specifications, pricing, and availability. Misleading or false information is strictly prohibited.
• Product Images: All images uploaded to your product listings must be of high quality, accurately represent the product, and must not infringe on any intellectual property rights.
• Prohibited Products: You must not list any products that are illegal, counterfeit, or otherwise prohibited by PPE CART’s policies. PPE CART reserves the right to remove any listings that violate these Terms.

3. Pricing and Payments

• Pricing: You are responsible for setting the prices for your products. Prices must be competitive and inclusive of any applicable taxes unless otherwise agreed.
• Payment Terms: PPE CART will process payments for products sold through the platform. Sellers will receive payments according to the payout schedule specified in the seller dashboard. All payments are subject to deductions for commissions and fees as agreed in the seller agreement.
• Commissions and Fees: PPE CART charges a commission on each sale, as well as fees for any additional services you opt for (e.g., subscription packages, marketing). Details of these fees are available in the seller dashboard.

4. Order Fulfillment and Shipping

• Order Processing: You are responsible for fulfilling orders promptly and accurately. Orders should be processed within the timeframe specified in your product listing.
• Shipping and Delivery: You must use reliable shipping methods to ensure timely and safe delivery of products to customers. Shipping costs and options should be clearly stated in your listings.
• Returns and Refunds: You must have a clear return and refund policy that complies with Australian consumer laws. This policy should be outlined in your seller profile and adhered to in all transactions.

5. Seller Conduct

• Professionalism: Sellers are expected to conduct themselves professionally at all times when using the PPE CART platform, including in communications with customers and PPE CART staff.
• Compliance with Laws: You agree to comply with all applicable laws, including consumer protection, data protection, and intellectual property laws.
• Intellectual Property: You warrant that you have the necessary rights and permissions to sell the products listed on PPE CART and that your products do not infringe on any third-party intellectual property rights.

6. Intellectual Property Rights

• Use of PPE CART Branding: You may not use PPE CART’s branding, logos, or trademarks without prior written consent, except as necessary to indicate that you are selling on the PPE CART platform.
• Product Listings: By listing products on PPE CART, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your product listings, including descriptions, images, and trademarks, for the purpose of promoting and operating the marketplace.

7. Termination of Seller Account

• Voluntary Termination: You may terminate your seller account at any time by providing written notice to PPE CART. Upon termination, all active listings will be removed from the marketplace.
• Termination by PPE CART: PPE CART reserves the right to suspend or terminate your seller account if you violate these Terms or engage in any activities that harm the platform or its users. In the event of termination, any outstanding payments due to you will be settled according to the payout schedule.

8. Limitation of Liability

• Platform Availability: PPE CART strives to maintain a reliable platform, but we cannot guarantee uninterrupted access to the marketplace. We are not liable for any losses resulting from downtime or technical issues.
• Liability Cap: To the extent permitted by law, our total liability to you in connection with these Terms will not exceed the total commissions earned by PPE CART from your sales in the 12 months preceding the claim.

9. Dispute Resolution

• Customer Disputes: You are responsible for resolving any disputes with customers related to your products. PPE CART may assist in mediating disputes at our discretion.
• Disputes with PPE CART: Any disputes between you and PPE CART will be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute may be escalated to arbitration as governed by Australian law.

10. Modifications to Terms

• Updates to Terms: PPE CART may update these Terms from time to time. You will be notified of any significant changes, and your continued use of the platform constitutes acceptance of the updated Terms.
